Law and Justice Interim Committee meeting Feb. 8th & 9th in Helena…

The Law and Justice Interim Committee will be meeting at 8:00 a.m. in Room 137 of the Capitol Building on Monday and Tuesday, February 8-9.

The meeting agenda and pre-meeting materials, including the draft minutes from the December committee meeting, have been posted to the committee’s webpage at the MT Legislature site

Most of the meeting will be focused on the SJR 39 study of DUI laws, with an emphasis on community-based treatment alternatives. Monday’s agenda will also highlight information gathered in a University of Montana study involving interviews and an opinion survey of WATCh participants. WATCh is a Department of Corrections treatment program for those convicted of felony DUIs.

A sobriety lab scheduled for Monday afternoon involves a detailed class for the committee members on field sobriety tests and blood alcohol content (BAC) breath testing. As part of the lab, volunteer committee members will be going to another room to drink in a controlled environment and then they will return to the committee meeting to go through the sobriety and breath tests.

The meeting on Tuesday, Feb. 9, will include a presentation by Chief Justice Mike McGrath, who will discuss a citizen initiative to combat drug and alcohol abuse.

Tribal leaders have also been invited to share comments and insights with the committee with respect to DUI laws and tribal programs.

Tuesday morning will be devoted to the SJR 29 study of DNA and will include the findings of a survey of local law enforcement agencys about preservation and storage of their biological evidence in felony criminal cases.

The meeting is open to the public and public participation and comment is invited. Please see the agenda for the scheduled public comment times.

Anyone presenting public comment is asked to please be respectful of everyone else interested in commenting and so to keep their comments brief. Also, the committee secretary welcomes written comments that may be entered as exhibits into the meeting minutes.
